Terms of Service

1. About Moj NutriPlan
Moj NutriPlan (the "Service") is a software-as-a-service (SaaS) platform for independent nutritionists and small clinics. It helps nutritionists build meal plans, manage recipes, generate shopping lists, schedule appointments, and communicate with their clients through a shared web application.
The Service is operated by Nenad Jokić, based in the Republic of Serbia (the "Operator", "we", "us"). Contact: [email protected].
2. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms of Service and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract. The Service is intended for use by nutrition professionals and their adult clients. The Service does not provide medical advice and is not a substitute for professional diagnosis or treatment.
4. Accounts
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
5. Subscription Plans
The Service is offered exclusively as a recurring subscription, billed monthly or annually, in EUR. We currently offer three tiers:
- Starter: €29 / month (or €290 / year), up to 5 clients.
- Pro: €69 / month (or €690 / year), up to 25 clients.
- Unlimited: €119 / month (or €1,190 / year), unlimited clients.
All annual plans include two months free compared to the monthly price. Pricing may change with at least 30 days' notice; existing subscribers will be billed at the previous rate until the end of their current period.
6. Free Trial
New accounts receive a 30-day free trial. No payment method is required during the trial. If you do not subscribe before the trial ends, your workspace switches to a read-only state and your data is retained for 30 days before deletion (see our Privacy Policy).
7. Payments & Billing
All payments are processed by Lemon Squeezy, our payment provider and Merchant of Record. Lemon Squeezy handles VAT and applicable sales taxes on our behalf. We do not store your full payment card details. Recurring payments are charged at the start of each billing period.
8. Cancellation & Refunds
You may cancel your subscription at any time from your billing portal. Cancellation stops future renewals; your subscription remains active until the end of the period you have already paid for. Refund eligibility is governed by our Refund Policy, which includes the statutory 14-day right of withdrawal for EU consumers where applicable.
9. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of applicable laws;
- upload content that infringes third-party rights or contains malware;
- attempt to gain unauthorised access to the Service or its underlying systems;
- scrape, mass-export, or resell data belonging to other users;
- use the Service to send unsolicited messages (spam) to clients or third parties;
- impersonate any person or misrepresent your professional credentials.
10. Your Content and Client Data
You retain ownership of the meal plans, recipes, client records, and other content you create in the Service (collectively, "Your Content"). You grant us a limited, non-exclusive licence to host, store, and process Your Content solely as necessary to operate and improve the Service.
When you, as a nutritionist, enter information about your clients, you act as the data controller in respect of those clients under the EU General Data Protection Regulation (GDPR). We act as a data processor on your behalf. You are responsible for obtaining the necessary consents from your clients and for the accuracy of the data you enter.
11. Intellectual Property
The Service, including its software, design, logos, and the "Moj NutriPlan" name, is owned by the Operator and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written permission.
12. Service Availability
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. Planned maintenance will be announced in advance where possible. We are not liable for downtime caused by force majeure, third-party providers, or your own connectivity.
13. No Consulting or Professional Services
We sell only access to the Service as a self-serve subscription. We do not provide consulting, nutrition advice, custom development, or any other professional service through this platform. Any nutrition advice delivered to a client comes from the nutritionist using the Service, not from us.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is not intended to diagnose, treat, cure, or prevent any disease.
15. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or exemplary damages. This limitation does not affect your statutory rights as a consumer.
16. Termination
We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that harms us, other users, or third parties. Upon termination, your right to use the Service ends immediately. You may export your data from /profil at any time before termination.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Serbia, without prejudice to mandatory consumer-protection rights in your country of residence. Any dispute will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to the competent courts in Belgrade, Serbia, unless mandatory law provides otherwise.
